　　4 Action for the price
　　4.1 Where the breach of contract is non-payment of the price the seller can sue for the price. This is an action for a specified sum. No question of remoteness will arise and there will be no duty to mitigate.
 
　　5 Quantum meruit
　　5.1 Claimant sues for value of work done:
　　Where damages are unavailable for example where the contract made was for the performance of a service and the other party has prevented completion of the performance.
　　The claimant having not performed his side of the bargain cannot sue for damages but he can claim quantum meruit.
 
　　6 Limitation Acts
　　The Limitation Acts impose a restriction on actions for breach of contract. The action must be commenced within six years of the breach being discovered, unless the contract was made in the form of a deed in which case the time limit will be extended to twelve years.
